John Pearson is an associate in the San Diego office who has vast experience in several practice areas. Mr. Pearson has successfully handled claims involving commercial and personal automobile and trucking liability, catastrophic injury and brain damage, California government tort defense, toxic tort, commercial and personal residence premises liability, ADA claims, business tort, property damage, uninsured/underinsured motorist, elder abuse, construction defect, injuries, and site accidents, professional malpractice and product liability / warranty actions.
Mr. Pearson also has experience in defense of government tort claims and administrative writ actions including writs of mandamus, excessive force and 42 U.S. Code 1983 actions, actions for foreclosure of mechanics’ liens, stop notices, actions on payment bonds, breach of construction contracts, delay claims, insurance coverage and bad faith defense and complex construction defect in both California and Nevada (owners, contractors, developers, and sub-trades).
Further experience includes defending real estate errors and omissions policies including handling of multi-party real estate disputes for failure to disclose, fraud, warranty, nondisclosure, property line disputes, landslide, soil subsidence, breach of fiduciary duty and fraudulent nondisclosure actions, and claims for damage caused by water intrusion, view obstructions and mold damage/injuries.
John has successfully represented multi-unit residential and commercial property owners in breach of warranty, contract, warranty of habitability, Civil Code 1941.1 claims, nuisance, abatement claims, and Unruh Civil Right Act litigation for over 10 years and has prevailed on numerous dispositive motions in actions against residential and commercial property owners.
He has successfully resolved several hundred civil lawsuits and has extensive experience in both plaintiff and defense litigation.
