Of counsel appellate specialist, Neil Tardiff, recently won an appeal in the Fourth District Court of Appeals confirming costs owed by plaintiff pursuant to defendants’ C.C.P. § 998 offer to compromise. Although plaintiff claimed a traumatic brain injury, the jury returned a verdict in favor of plaintiff in the amount of $3,000. Mr. Haggerty tried the underlying case in Indio Superior Court. Costs and expert fees on behalf of the firm’s client totaled $162,000. On June 19, 2015, the Appellate Court remanded the case back to the trial court to determine reasonable costs.
