Of counsel appellate specialist, Neil Tardiff, recently won an appeal in the Fourth District Court of Appeals confirming costs owed by plaintiff pursuant to defendants’ C.C.P. § 998 offer to compromise. Although plaintiff claimed a traumatic brain injury, the jury returned a verdict in favor of plaintiff in the amount of $3,000. Mr. Haggerty tried the underlying case in Indio Superior Court. Costs and expert fees on behalf of the firm’s client totaled $162,000. On June 19, 2015, the Appellate Court remanded the case back to the trial court to determine reasonable costs. That hearing is pending. See Litt v. Eisenhower Medical Center, 237 Cal.App.4th 1217; 188 Cal.Rptr. 3d 785. (2015)
