Associate David Mendoza and Partner Charlie Schmitt prevailed on a Motion for Summary Judgment in favor of a subcontractor in a wrongful death case in Ventura County Superior Court. The plaintiffs alleged their decedent was electrocuted by power line while trimming trees. The plaintiffs alleged that a subcontractor owed the decedent a duty of care by assuming a contractual obligation to inspect trees growing in and around power line easements in residential neighborhoods, reporting to the power company on the location of tree requiring remedial pruning, and notifying the homeowner. The Court found that the subcontractor did not owe a duty of care to the decedent. Plaintiffs did not appeal.
