Attorney David Mendoza was successful in striking almost $1,000,000 in costs

Attorney David Mendoza was successful in striking almost $1,000,000 in costs from an opponent’s cost bill post-trial.  The matter stems from an auto versus motorcycle accident where the jury returned a verdict in favor of Plaintiff.  After the trial, Plaintiff filed a memorandum of costs totaling $1,001,622.62, relying on a 998 issued in 2020.  Attorney David Mendoza prepared and filed a Motion to Strike/Tax Plaintiff’s Costs, challenging the validity of the 998 on two grounds: (1) The 998 was invalid because it did not include a release and failed to state with specificity the terms of settlement and (2) The 998 was not made in good faith because of suspicious timing.  The Court agreed and granted our Motion on both grounds, striking $935,776 of plaintiff’s post-trial costs.
