Partner Mary Pendleton prevailed on a Motion for Summary Judgment

Partner Mary Pendleton prevailed on a Motion for Summary Judgment in favor of the County of San Diego in an alleged dangerous condition of public property that caused extensive bodily injury.  The Motion was based on evidence supporting the affirmative defense that the County of San Diego lacked notice of any injurious condition of the public property before the incident.  The Motion was opposed, but was granted by the Honorable Judge Timothy Taylor, San Diego Superior Court.  Ms. Pendleton has written several other dispositive motions for municipalities and public entities including a recent Motion for Summary Judgment filed on behalf of the City of El Cajon demonstrating that there was a lack of evidence that any dangerous condition existed at the time of plaintiff’s fall.  The City of El Cajon was dismissed before the Motion was heard.
