FWHB attorney recently won a Motion for Summary Judgment in the Oakland Superior Court in which the nurse-plaintiff was claiming toxic exposure to chemicals at two Bay Area hospitals. Plaintiff claimed permanent residual damages including severe chemical sensitivity with accompanying bronchospasms, laryngospasms, wheezing and migraines as well as anxiety and panic attacks. Medical specials totaled $175,000 and the total past and future wage loss claimed was approximately $2 million. The potential verdict value of the case was between $3 million and $5 million. Our attorney successfully argued that plaintiff could not prove the necessary causation. There was no appeal of the trial court’s ruling. (2015)
