Facts: The matter arose out of a slip and fall accident of disputed liability. Plaintiff claimed significant personal injuries that were life-changing. Plaintiff’s spouse asserted a loss of consortium claim. The Court granted our Motion to exclude evidence of the non-injured spouse’s loss of earnings damages. Plaintiffs asserted claims of Premise Liability Negligence and Loss of Consortium. They alleged that the tile floor at the subject property was a dangerous condition when it became wet due to inclement weather. We claimed that Plaintiff was contributorily negligent for the accident, and that Defendants properly placed adequate warnings about the wet floor at the subject premises.
Damages: Plaintiff incurred significant medical bills and had leg surgery that required internal hardware. At trial, Plaintiffs argued that their damages were $2.4 Million.
Results: The jury deliberated for about one hour and thirty minutes and found in favor of Defendants by a 10-2 vote.
