Facts: The matter arose out of a two vehicle accident of disputed liability. Both vehicles were totaled. Plaintiff had two independent witnesses that claimed our client ran a red light. We claimed that plaintiff turned left in front of our client, who was traveling straight through the intersection. Nonetheless, the jury determined that our client was not at fault for the accident. Plaintiff was unconscious and altered after the accident. Plaintiff claimed a traumatic brain injury as well as chronic orthopedic pain. Additionally, plaintiff claimed he was at an increased risk of Alzheimer’s and dementia because of the accident.
Damages: Plaintiff sought $10,000,000 for pain and suffering.
Result: Defense verdict.
